Occupational safety when working with pesticides: The state of legal security

The article is devoted to the analysis of current state legal security labor protection when working with pesticides, as well formulation conclusions and proposals based on it, aimed at improving legislation in this area. It has been established that currently Ukraine, there a process updating area under study. In particular, through adoption regulatory acts governing rules certain types chemicals (for example, ammonium nitrate). As result study field it concluded basic documents (SSR 8.8.1.2.001-98 “Transportation, storage use pesticides national economy” DSanPiN 8.8.1.2.3.4-000- 2001 “Permissible doses, concentrations, quantities levels agricultural raw materials, food products, air area, atmospheric air, water ponds, soil”) are not able properly regulate relevant relationships due their outdated provisions. main shortcomings SSR identified: reference its content already inactive regulations protection, non-compliance modern developments hygiene toxicology pesticides; unreasonably detailed regulation, which entails an excessive burden business entities leads formalism implementation provisions document by employers; incorrectly “rigid” regulation choice means personal for work pesticides. determined directions improvement Among them: introduction risk-based approach organization including agriculture; borrowing positive international experience awareness interested parties about hygienic necessary safety measures such substances.
